Terms of Service

1. Acceptance of Terms & Account Registration

Welcome to KhidePeyechhe ("we", "us", "our", or "KhidePeyechhe.com"). These Terms of Service ("Terms") govern your subscription and use of the KhidePeyechhe cloud-based restaurant POS, Kitchen Order Ticket (KOT) system, QR table ordering platform, and website khidepeyechhe.com (collectively, the "Service").

To use the KhidePeyechhe POS system, you must register for a verified business account and provide accurate, complete, and current information including your legal restaurant name, GSTIN (if registered in India), primary contact details, and branch location addresses. You are strictly responsible for maintaining the confidentiality of your staff login credentials and PIN codes.

2. Offline-First POS & Sync Architecture

KhidePeyechhe is specifically engineered with an offline-first architecture utilizing Progressive Web App (PWA) local storage and IndexedDB queues to allow continuous billing and KOT generation during internet outages or power cuts.

• Local Device Queue: Orders created while offline are stored securely inside the local browser/device database and assigned a unique offline reference tag (`OFFLINE-XXXX`).
• Synchronization Requirement: You acknowledge that offline data must be synchronized with our cloud servers once internet connectivity is restored. Failure to reconnect the POS terminal for extended periods or clearing browser cache prior to synchronization may result in local data loss for which KhidePeyechhe shall not be liable.
• Deduplication Protection: Our sync engine employs cryptographic locks and server-side deduplication algorithms to prevent duplicate billing upon reconnection.

3. Hardware & Network Obligations

KhidePeyechhe operates across standard Android/iOS tablets, iPads, touch terminals, desktops, and mobile smartphones via modern web browsers (Chrome, Safari, Edge). You are responsible for procuring, maintaining, and securing compatible hardware and thermal receipt printers.

4. Subscription Plans, GST & Payment

All subscription charges are billed in Indian Rupees (INR / `₹`) either per branch or per organization according to the selected plan tier (`Starter`, `Growth`, or `Enterprise`).

• Indian GST Compliance: As per the Central Goods and Services Tax (CGST) Act, all applicable GST (18%) will be applied to your invoices where mandatory. We provide GST tax invoices with valid HSN/SAC codes for your business input tax credit (ITC).
• No Hidden Device Fees: Unlike traditional POS vendors, we do not charge per-terminal or per-device license fees within a single subscribed branch unless explicitly stated in customized enterprise agreements.
• Refund Policy: Subscription fees are billed in advance. You may cancel your subscription at any time; however, fees paid for the active billing period are non-refundable except where required by applicable law.

5. Data Ownership & Cloud Backups

You own 100% of your restaurant data. KhidePeyechhe claims no proprietary ownership over your menu items, customer contact lists, order histories, sales records, or uploaded dish images.

6. Acceptable Use Policy

You agree not to use the Service for any unlawful, fraudulent, or harmful activities. Specifically, you agree that you will not reverse engineer, decompile, or disassemble the KhidePeyechhe software or sync protocols, nor introduce viruses or automated scraping loads that disrupt server stability.

7. Specific Additional Terms for Restricted Products (Tobacco, Hookah, Nicotine)

Specific Additional Terms with respect to purchase of Cigarettes and Other Tobacco Products, hookah, rolling papers, and nicotine products. The user agrees and undertakes that:

• He/she is at least eighteen (18) years of age or above; and
• He/she lives outside the radius of hundred (100) yards from an educational institution.

User will not use the KhidePeyechhe Platform to purchase “cigarettes” and other “tobacco products” as defined under the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 if he/she is below the age of 18 years and/ or lives within the radius of hundred (100) yards from an educational institution or for a person who is below the age of 18 years and/ or lives within the radius of hundred (100) yards from an educational institution.

In addition to the above, in case it is found that user has made a false declaration and/or misrepresented its age to be eligible for placing an Order under this category, KhidePeyechhe also reserves a right to take an appropriate action against such user.

Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, undischarged insolvent etc. are not eligible to use/access the KhidePeyechhe Platform. However, if you are a minor, i.e. under the age of 18 years, you may use/access the KhidePeyechhe Platform under the supervision of an adult parent or legal guardian “competent to contract” who agrees to be bound by these Terms. You are however prohibited (even under supervision) from purchasing any product(s) which is for adult consumption or the sale of which to minors is prohibited, including any tobacco products.

8. Intellectual Property Rights

All source code, UI design, graphics, trademarks (`KhidePeyechhe`, `Taalsari Cafe POS`), workflows, and algorithms underlying the Service are the exclusive intellectual property of KhidePeyechhe and its licensors.

9. Limitation of Liability & Indemnification

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable Indian law, KhidePeyechhe's total cumulative liability arising out of or related to your subscription shall not exceed the total subscription fees paid by you during the six (6) months immediately preceding the incident.

10. Governing Law & Dispute Resolution

These Terms shall be governed by, and construed in accordance with, the laws of India, including the Information Technology Act 2000 and DPDPA 2023. Any dispute, controversy, or legal claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent civil courts located in Kolkata, West Bengal, India.
